Yeah, "sold out" just seems as scammy as the cards themselves, he will obviously milk this thing dry with future releases of new sets.

Normally you can't short NFT's. But as it is a collection you could have constructed an artificial short-position out of it. Now it is too late. You would have lost money anyways.

You can derive it from simple logic
